Inspiring Juvenile Law Reform in Wakatobi through the Values of Prophet Ishmael

Introduction

The fatal beating and stabbing in Wakatobi involving a 16-year-old child, identified as F, and his father has deeply shaken the public. This case not only adds to the statistics on crimes involving minors, but also serves as a stark reflection of systemic gaps in legal and social governance. The heartbreaking incident has exposed a pressing crisis of accountability within Indonesia’s juvenile criminal justice system.

Judges face a profound moral quandary when presiding over violent crimes resulting in the loss of human life committed by minors. While imposing firm legal consequences is vital to uphold legal certainty, provide formal justice to victims and their families, and soothe public outrage, judicial conscience reminds us that punitive measures alone merely address symptoms rather than the complex root causes of juvenile offense.

Relying on the judicial system as the sole mechanism for penalizing children, without addressing their broader social environment, signals a collective failure to protect and nurture youth. This crisis feels particularly stark when contrasted with the spirit of Youth Pledge Day, celebrated every October 28th. That historic pledge underscores a national commitment to the younger generation as pillars of the nation’s future, a philosophy enshrined in Law No. 40 of 2009 on Youth. This legislation establishes constitutional obligations for the state, government, and society to empower youth and foster responsible, devout, and competitive citizens.

When a youth becomes entangled in a lethal crime alongside a parent, it highlights a breakdown in social and parental support systems during a critical developmental transition. In practice, juvenile cases often draw intense public pressure demanding maximum retribution. However, Law No. 11 of 2012 on the Juvenile Criminal Justice System (SPPA) and the new Criminal Code (KUHP) provide a progressive foundation, granting courts the flexibility to prioritize educational and rehabilitative measures in the best interest of the child.

Diah Sulastri Dewi (2020) emphasizes that shortcomings in implementing child protection principles often stem from flawed perceptions. Illegal acts by children are frequently viewed as fully autonomous, adult choices. Yet, developmental psychology and neuroscience demonstrate that individuals under eighteen lack fully developed cognitive capacity, emotional control, and character. Peer pressure, impulsivity, and negative environmental influences significantly shape their actions.

Consequently, juvenile court proceedings require a holistic evidentiary approach. Judges must look beyond viewing children strictly as offenders, recognizing them as vulnerable individuals who are often victims of broader social neglect—lacking proper parental guidance, exposed to violence, and unsupported by community safeguards.

Reflections on Ishmael’s Example: Foundational Parenting and the Courage to Reject Injustice

In the context of Youth Pledge Day, the prophetic history of Prophet Ishmael offers valuable reflection on generosity, courage, and integrity.

The account of Prophet Abraham and Prophet Ishmael laboring together to construct the foundations of the Ka’bah exemplifies constructive, collaborative parenting: a father providing purposeful direction and a son engaging in noble acts that strengthen societal foundations.

Beyond obedience, Prophet Ishmael’s story highlights the essential ability to discern truth and reject injustice, demonstrating strong moral character and a commitment to fairness.

Modern youth require moral clarity to navigate complex environments and resist harmful influences, even from within their families. The tragic event in Wakatobi illustrates the vulnerability of character development when positive parental guidance is absent and children lack the moral agency to resist wrongful acts.

A Shift in Doctrine: Shared Responsibility and Restorative Justice

Corrective detention at the Special Correctional Institution for Children (LPKA) serves a lawful and proportionate function under the Child Protection Act. However, for law enforcement to achieve genuine rehabilitation, punitive judicial actions must be balanced with robust preventive measures and community support under a framework of shared responsibility.

Under this doctrine, accountability for juvenile delinquency should extend beyond the child. Parents, guardians, or adults who neglect, facilitate, or incite criminal acts must be held legally accountable. This aligns with the principle in the Child Protection Act that imprisonment for children must remain a measure of last resort (ultimum remedium), applicable only when rehabilitative alternatives are exhausted.

Addressing juvenile delinquency in regions like Wakatobi calls for resilient community ecosystems built on early identification and intervention. This approach requires active collaboration among local leaders, educators, social workers, and law enforcement. As Diah Sulastri Dewi highlights, successful rehabilitation depends on Community Supervisors (PK Bapas) and professional social workers who guide, supervise, and support the child’s psychological and social reintegration.

Simultaneously, achieving justice for victims and their families remains essential. Compensatory and restorative mechanisms help redress harm and alleviate suffering, complementing juvenile rehabilitation so offenders understand the gravity of their actions and reform.

This approach aligns with Islamic Legal Philosophy (Filsafat Tasyri’), where sanctions (Ta’zir) aim not at retribution, but at fulfilling core objectives (Maqasid asy-Syari’ah), specifically protecting life (Hifz an-Nafs) and safeguarding future generations (Hifz an-Nasl). Recognizing that children are born with inherent purity (fitrah), juvenile offense serves as a call for society to strengthen parenting, education, and community guidance.

Conclusion

The Wakatobi case underscores the need to continually enhance Indonesia’s juvenile justice system. The judicial role extends beyond delivering courtroom verdicts to delivering meaningful legal education and restorative outcomes to society.

Embracing the spirit of Youth Pledge Day means committing to shared responsibility, combining statutory protections with character-building values exemplified by figures like Prophet Ishmael, to guide, nurture, and prepare the next generation.
